RaceOneDesign ("us", "we", or "our") provides a Web site, related data, and services (referred to hereafter as "the Website"). RaceOneDesign takes your privacy seriously. Please read the following to learn more about our privacy policy, which includes compliance with California Privacy Rights.

RaceOneDesign respects your privacy and is committed to protecting personally identifiable information you may provide us. RaceOneDesign has adopted this privacy policy ("Privacy Policy") to explain what information may be collected on the Website, how we use this information, and under what circumstances we may disclose the information to third parties. This Privacy Policy applies only to information we collect through the Website. This Privacy Policy, together with the Terms of Use posted on the Website, sets forth the general rules and policies governing your use of RaceOneDesign. You should review this Privacy Policy frequently, as we may change it from time to time without notice. Any changes will be effective immediately upon the posting of a revised Privacy Policy.

If, at any point, we decide to use your personally identifiable information in a manner materially different than what was stated in this Privacy Policy at the time it was collected, we will notify you of this change by e-mail to the last e-mail address provided to us. You will have a choice (by means of an opt out opportunity) as to whether or not we use your information in this different manner. RaceOneDesign will use your information in accordance with the privacy policy under which the information was collected if you choose to opt out of the new policy.

1. INFORMATION COLLECTION

RaceOneDesign typically collects two kinds of information about you: information that you provide that personally identifies you; and information that does not personally identify you, that you provide RaceOneDesign or that we automatically collect when you visit the Website.

(A) RaceOneDesign does not automatically collect your personally identifiable information when you visit the Website. However, when you register on the Website to create a Membership we may ask for information such as your name, email address, mail address, phone number, birth date, gender, ZIP code, occupation industry, and personal interests including but not limited to your interest in sailboat racing. When you register with RaceOneDesign, you are not anonymous to us. In certain other circumstances, we may request or provide you with an opportunity to submit your personally identifiable information in connection with a feature, program, purchase, promotion or some other aspect or service of RaceOneDesign. Whether or not you provide this information is your choice; however, in many instances this type of information is required to participate in the particular activity, realize a benefit we may offer, or gain access to certain content on RaceOneDesign.

(B) Non-personal information is any information that does not personally identify you. Non-personal information can include certain personally identifiable information (such as your age) that has been de-identified; that is, information that has been rendered anonymous. RaceOneDesign obtains non-personal information about you from information that you provide us, either separately or together with your personally identifiable information. 2. INFORMATION USE, SHARING, AND DISCLOSURE

(A) The personally identifiable information you submit to us is generally used to carry out your requests, respond to your inquiries, better serve you, or in other ways naturally associated with the circumstances in which you provided the information. RaceOneDesign may use this information to contact you for a variety of reasons, such as customer service, providing you with promotional information for our products or those of our subsidiary, affiliated, or partner companies, or to communicate with you about content or other information you have submitted to or posted on the Website. You may opt-out from receiving promotional information from us or our affiliated companies, or direct that we not share your information with any affiliated companies. RaceOneDesign does not rent, sell, or share personally identifiable information with other people or non-affiliated companies except to provide products or services that you have specifically requested and when we have your prior approval. We may provide the information to trusted partners who work on behalf of or with RaceOneDesign under confidentiality agreements. These companies may use your personal information to help RaceOneDesign communicate with you about offers from RaceOneDesign and our marketing partners. However, these companies do not have any independent right to share this information. We may also provide personally identifiable information when responding to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. 3. OTHER USES AND INFORMATION

(A) When you request pages from RaceOneDesign servers, our servers may log your IP addresses. An IP address is a number that is automatically assigned to your computer whenever you are using Internet resources such as websites. RaceOneDesign collects IP addresses for purposes of system administration, to report aggregated non-personal information to others, and to track the use of the Website. IP addresses are considered non-personal information and may also be shared as provided above. It is not our practice to link IP addresses to anything personally identifiable; that is, your session may be logged, but you remain anonymous to us. RaceOneDesign reserves the right to use IP addresses to identify a visitor when we feel it is necessary to enforce compliance with RaceOneDesign terms of use, to fulfill a government request, to conform with the requirements of the law or legal process, to protect or defend our legal rights or property or the rights or property of other RaceOneDesign users, or in an emergency to protect the health and safety of RaceOneDesign's users or the general public.

(B) RaceOneDesign may set and access RaceOneDesign cookies on your computer. Cookies are small text files that are stored on your hard drive. These text files make using RaceOneDesign more convenient by, among other things, saving your passwords and preferences for you. Cookies do not typically contain any personally identifiable information. RaceOneDesign may analyze the information derived from these cookies and other technological tools we employ (such as web beacons) and match this information with data provided by you or another party. RaceOneDesign may provide our analysis and certain non-personal information to third parties (who may in turn use this information to provide advertisements tailored to your interests), but will not disclose any of your personally identifiable information in this way. 4. USER CONTENT AND PUBLIC FORUMS

RaceOneDesign may now or in the future offer chat rooms, message boards, bulletin boards, or similar public forums where you and other users of RaceOneDesign can communicate. In addition, RaceOneDesign may now or in the future permit you to submit, post, edit, or comment upon user content such as but not limited to user profile pages, technical articles, product reviews, blog postings, and sailboat racing reports. The protections described in this Privacy Policy do not apply when you provide information (including personally identifiable information) in connection with your use of these public forums or when submitting, modifying, or commenting on user content. We may use personally identifiable information (for example, the name, city, and state that you submitted during registration) and non-personal information to identify you with a posting in a public forum, revision of user content, or a comment on user content. Any information you share in a public forum or is associated with user content is public information and may be seen or collected by anyone, including third parties that do not adhere to our Privacy Policy. RaceOneDesign are not responsible for events arising from the distribution of any information you choose to publicly post or share through RaceOneDesign.

5. CHILDREN UNDER THE AGE OF THIRTEEN

The features, programs, promotions and other aspects of RaceOneDesign requiring the submission of personally identifiable information are not intended for children. RaceOneDesign do not knowingly collect personally identifiable information from children under the age of 13. If you are a parent or guardian of a child under the age of 13 and believe he or she has disclosed personally identifiable information to us please contact us at user-services@raceonedesign.com. A parent or guardian of a child under the age of 13 may review and request deletion of such child's personally identifiable information as well as prohibit the use thereof. 6. KEEPING YOUR INFORMATION SECURE

RaceOneDesign has implemented security measures we consider reasonable and appropriate to protect against the loss, misuse, or alteration of the information under our control. However, we cannot guarantee or warrant the security of any information you disclose or transmit to us online (including personally identifiable information) and are not responsible for the theft, destruction, or inadvertent disclosure of your personally identifiable information. In the unfortunate event that your personally identifiable information is compromised, we may notify you by e-mail at our sole and absolute discretion to the last e-mail address you have provided us in the most expedient time reasonable under the circumstances. Delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system as well as for the legitimate needs of law enforcement if notification would impede a criminal investigation. From time to time we evaluate new technology for protecting information, and when appropriate, we upgrade our information security systems. Personal information will be processed and stored by RaceOneDesign in databases hosted in the United States.

RaceOneDesign may link to or contain links to other third-party websites that we do not control or maintain, such as in connection with purchasing products that are referenced or reviewed on RaceOneDesign and advertised on the Website. RaceOneDesign is not responsible for the privacy practices employed by any third-party website that RaceOneDesign links to or that is referred to in any RaceOneDesign content including content that is submitted, edited, commented-upon by users. RaceOneDesign does not provide a means to opt-out of third-party websites that RaceOneDesign links to, and we cannot assist you in opting out of any third-party websites.

RaceOneDesign will respond to your request and, if applicable and appropriate, make the requested change in our active databases as soon as reasonably practicable. Please note that we may not be able to fulfill certain requests and still allow you access to certain benefits and features of RaceOneDesign.

9. SOLE STATEMENT

This Privacy Policy as posted on the Website is the sole statement of our privacy policy with respect to the Website, and no summary, modification, restatement or other version thereof, or other privacy statement or policy, in any form, is valid unless we post a new or revised policy to RaceOneDesign at the following link: www.raceonedesign.com/privacy-policy. It is your responsibility to review the Privacy Policy as posted on the Website from time to time for any changes. Your access and use of any of the Website following any modification of this Privacy Policy will signify your assent to and acceptance of the same. If you object to any subsequent revision to the Privacy Policy, you may terminate your Membership as provided in the Website's Terms of Use and immediately discontinue use of the Website. If you do not have a Membership, your only recourse is to immediately discontinue use of the Website.
